This End User Licence Agreement ("EULA") is a binding agreement between you ("End User" or "you") and Misha Enterprises Ltd. ("Licensor"), a company incorporated in British Columbia, Canada, for use of the Sausage Guru mobile application ("App").
This EULA incorporates the Terms of Service and Privacy Policy by reference. By downloading or using the App, you agree to this EULA.
1. Grant of Licence
Subject to the terms of this EULA and payment of any applicable fees, Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, solely for your personal, non-commercial purposes.
2. Restrictions
You may not:
- Copy, modify, or distribute the App or any portion of it
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Remove or alter any proprietary notices or labels
- Use the App for any commercial purpose without written consent
- Create derivative works based on the App
3. Apple App Store — Additional Terms
If you downloaded the App from the Apple App Store, the following additional terms apply:
- This EULA is between you and Misha Enterprises Ltd. only, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
- The licence granted is limited to use on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support services for the App.
- In the event of any failure of the App to conform to any warranty, you may notify Apple for a refund of the purchase price; Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property infringement.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, Apple will have the right to enforce this EULA against you.
4. Google Play — Additional Terms
If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service. In the event of a conflict between this EULA and the Google Play Terms, this EULA governs to the extent of the conflict.
5. In-App Purchases
The App offers optional in-app purchases for Pro and Cloud subscription tiers. All purchases are processed by the respective app store (Apple App Store or Google Play). Subscriptions automatically renew unless cancelled. Refunds are subject to the applicable store's refund policy.
6. Ownership
The App and all copies thereof are the proprietary property of Misha Enterprises Ltd. and title thereto remains with Misha Enterprises Ltd. All rights in the App not specifically granted in this EULA are reserved to Misha Enterprises Ltd.
7. Updates
Licensor may from time to time develop patches, bug fixes, updates, upgrades, and other modifications ("Updates"). Updates may be automatically installed without additional notice. You consent to these automatic Updates. If you do not want Updates, you must stop using and uninstall the App.
8. Term and Termination
This EULA is effective until terminated. It will terminate automatically if you fail to comply with any term. Upon termination, you must destroy all copies of the App in your possession.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE APP IN THE PRECEDING TWELVE MONTHS.
11. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
